حقوق بين الملل زاييده تاريخ است و مطالعة تحولات آن جز در پرتو مطالعة تاريخ تحول جامعه بين المللي مقدور نمي باشد. حقوق بين الملل همانند جامعه جهاني دوره هاي مختلفي را از قرن هفدهم تا كنون پشت سر گذاشته است. هر دوره از مرحلة تكاملي حقوق بين المللي ويژگيهايي داشته كه آن را از دوره هاي ديگر متمايز مي كند.

نقطه مشترك همه اين دوره ها در اين حقيقت تلخ نهفته است كه هر دوره علايق‘ آرمان ها و تمايلات دولت هايي را منعكس مي كند كه به لحاظ سياسي‘ اقتصادي و نظامي ‘ در موقعيتي قرار داشتند كه ديگران مجبور به پذيرش هژمني (سر كردگي) آنها بوده اند. از اين رو حقوق بين الملل در هيچ دوره اي محصول تعامل و مشاركت تمدن هاي مختلف بشري نبوده است ومتأثر از فرهنگ كشورهاي قدرتمند بوده است.
